These Terms of Sale govern your purchase of products through Furniture Department. They apply in addition to our Terms of Service, Privacy Policy, and Return & Refund Policy, each of which is incorporated by reference. By placing an order, you agree to these Terms of Sale.
Furniture Department is an online marketplace operated by Furniture Department LLC ("we," "us," "our"). Many products are sold and fulfilled by independent third-party manufacturers and vendors ("Sellers") who list their products on our platform. When you place an order, you are entering into a contract of sale that may be with us or with the applicable Seller, who is responsible for the manufacture, packaging, and shipment of the product.
Regardless of which party is the seller of record, we coordinate the order, process your payment, and provide customer support, and the policies on this page apply to your purchase.
Your order is an offer to purchase. All orders are subject to acceptance and to product availability. We (or the applicable Seller) may accept or decline your order for any lawful reason, including:
An order confirmation acknowledges receipt of your order; it does not constitute acceptance. Acceptance — and the formation of a contract of sale — occurs when we send a shipping confirmation for the product. If we cancel an order after you have been charged, we will issue a refund to your original payment method.
Shipping charges are calculated at checkout based on your delivery address and the items in your cart. For larger items shipped by freight (less-than-truckload / LTL), the shipping cost shown at checkout is a real, per-Seller freight quote for your specific address rather than a flat estimate. If one or more items cannot be shipped to your address, checkout will indicate that the order cannot be completed for that destination.
We currently ship within the United States and to Canada. Orders shipped to Canada may be subject to import duties, taxes, and customs fees that are your responsibility.
Retention of title. We (or the applicable Seller) retain title to all merchandise until it has been delivered to you and paid for in full. You become the owner of the merchandise once both conditions are met; risk of loss passes as described above.
Payments are processed securely by Stripe. We do not store your full payment card number. By submitting payment, you:
Because we operate a marketplace, payments may be facilitated through Stripe Connect and settled to the applicable Seller. Your card statement may reflect a descriptor associated with Furniture Department.
You may be able to place orders for our products through third-party AI assistants, agents, or commerce platforms (for example, via agentic checkout integrations). Orders placed through those channels are subject to these Terms of Sale and our other policies to the same extent as orders placed directly on our website. You are responsible for the accuracy of the order details (including item, quantity, and shipping address) submitted on your behalf, and you can manage or return such orders through your Furniture Department account or by contacting customer support.
You may cancel an order before it ships, where the option is available in your account. Once an order has shipped, our Return & Refund Policy applies. That policy — including the 30-day return window, items that are non-returnable (such as custom, made-to-order, clearance, and certain hygiene-sensitive items), refund timing, and the process for damaged or defective goods — forms part of these Terms of Sale.
The Seller is responsible for the accuracy and completeness of its product listings — including descriptions, images, dimensions, materials, and any product claims, certifications, or warranty information. We display the information Sellers provide and work to present it clearly, but we do not independently verify it. Colors, textures, and dimensions may also appear differently depending on your device, and minor variations are inherent to many furniture products.
Many products are covered by a manufacturer's warranty; warranty terms vary by manufacturer and product and are provided with the product where applicable. Except for any applicable manufacturer's warranty and any warranties that cannot be excluded under applicable law, products are provided "as is" to the fullest extent permitted by law, and we disclaim implied warranties of merchantability and fitness for a particular purpose.
Nothing in these Terms of Sale limits any rights you may have under mandatory consumer-protection laws that cannot be waived.
To the maximum extent permitted by law, our total liability arising out of or relating to a product or order will not exceed the amount you paid for that order. We are not liable for indirect, incidental, special, consequential, or punitive damages. This section does not limit liability that cannot be limited under applicable law.
These Terms of Sale are governed by the laws of the State of California, without regard to its conflict-of-law principles. The dispute-resolution, arbitration, and class-action-waiver provisions of our Terms of Service apply to disputes relating to your purchase.
