1. Manufacturer's Warranty

Products sold on furniture.com ("the Site") may be covered by a written warranty issued by the product's manufacturer and/or by [RTG / other named warrantor, if applicable] (each, the "Manufacturer's Warranty"). The terms, conditions, duration, and claims process for the Manufacturer's Warranty are set by the manufacturer (or other named warrantor), not by Furniture.com America LLC ("FD," "we," "us," or "our"). A copy of the applicable Manufacturer's Warranty is provided [with your order / in the product packaging / at [link]] and should be reviewed and retained by the customer.

FD does not manufacture the products sold on the Site and does not issue any independent written warranty of its own on the products. FD's role with respect to product warranties is limited to facilitating your purchase and, where applicable, helping direct you to the appropriate manufacturer or warrantor for warranty service.

2. Disclaimer of Implied Warranties

EXCEPT FOR THE MANUFACTURER'S WARRANTY DESCRIBED ABOVE, THE PRODUCTS SOLD ON THIS SITE ARE SOLD "AS IS," WITHOUT ANY WARRANTY OF ANY KIND FROM FD, WHETHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FD HEREBY DISCLAIMS ALL IMPLIED WARRANTIES WITH RESPECT TO THE PRODUCTS, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.

This means that if a product is defective, damaged, or fails to work as expected, your recourse for a remedy (repair, replacement, refund, etc.) is against the manufacturer (or other named warrantor) under the terms of the Manufacturer's Warranty — not against FD. FD makes no promise, and assumes no responsibility, that any product will be merchantable or fit for any particular purpose beyond what is expressly stated in the Manufacturer's Warranty itself.

3. Where a Disclaimer Cannot Be Given Full Effect

Some states do not allow the disclaimer of implied warranties, or limit how or how long such a disclaimer may apply, so the disclaimer in Section 2 may not apply to you in full, or at all. In any jurisdiction where applicable law does not permit FD to disclaim an implied warranty entirely, that implied warranty is limited, to the fullest extent permitted by law, in duration to the length of the applicable Manufacturer's Warranty period. This Section 3 applies automatically and takes precedence over Section 2 solely to the extent required by the law of your state.

This policy does not affect, and is not intended to waive, any non-waivable consumer protection rights you may have under the laws of your state.

4. How to Make a Warranty Claim

To make a claim under the Manufacturer's Warranty:

  • Locate the Manufacturer's Warranty document included with your product, or [link to where customers can look it up by product/SKU].
  • Contact the manufacturer (or other named warrantor) directly using the contact information provided in that warranty document[, or contact FD Customer Care at FD PHONE NUMBER AND EMAIL and we will help direct you to the appropriate party].
  • Have your order number, proof of purchase, and a description of the issue ready — the manufacturer may require these to process a claim.

FD is not the warrantor and does not independently evaluate, approve, or pay warranty claims on the manufacturer's behalf, except where we expressly agree to do so in writing.
